Supreme Court Takes Up Challenge To Sweeping EPA Carbon Rules

Companies challenging the Environmental Protection Agency’s sweeping new regulations of CO2 emissions got good news today when the U.S. Supreme Court agreed to hear an appeal of a lower-court decision dismissing their case.
 
By accepting Chamber of Commerce v. EPA, the high court breathes new life into a case questioning the EPA’s authority under a federal law regulating tailpipe emissions to also regulate CO2 emissions from stationary sources like power plants. The Supreme Court won’t be hearing a challenge to the scientific conclusion that greenhouse gases are dangerous pollutants, however, and it may proceed with limiting carbon emissions from stationary sources under other laws regardless of how the Supreme Court rules.
